@fontana, I agree #Red_Hat publication of #swpats promise set the bar too low, allowing #IBM & others to skirt issue. Fix it now, though!

So MSFT is cashing innovation tax (aka patent license money) for Android, now ORCL joins the scheme. And you still ask why #swpat are wrong?

@jwildeboer why make money from innovation when you can simply collect taxes from all the competition?

@jwildeboer, Does #Red_Hat believe #swpats are wrong, or is that just your personal opinion? Why won't Red Hat license its #swpats freely?

@bkuhn In #Patent_Absurdity, someone from #RedHat made statements against #swpats and said that it didn't advance innovation.

@bkuhn But sure, it is annoying that RedHat won't freely license its patents.

@bkuhn nice blog. One of the more level headed responces I've seen to OvG

@bkuhn It is first my personal belief (check my history, funny pics ;-) and Red Hat also opposing. But we have some defensive pat going on.

@bkuhn wrt freely licensing - that's for our legal experts. We have patent promise at least.

@jwildeboer, #Microsoft has #swpats promises; #Red_Hat no better? Why won't Red Hat grant !GPLv3 -compatible patent licensing? (cc @fontana)

    • Jan Wildeboer Jan Wildeboer

@bkuhn AFAIR we had our promise long before others did.

      Monday, 16-Aug-10 13:13:51 UTC
    • Jan Wildeboer Jan Wildeboer

@bkuhn And as you can see at http://www.redhat.com/legal/patent_policy.html we DO include GPL v3.

@jwildeboer, promise is not a license; e.g. #Red_Hat reserves right to sell off patents to trolls. Why does RedHat insist on this power?

@bkuhn wrt to your blog entry - is PHP really safe? Isn't Zend a risk?

      Monday, 16-Aug-10 13:51:39 UTC

@jwildeboer, My understanding is that #Zend is not necessary to use #PHP. Am I mistaken? Also, AFAIK Zend post-dates PHP's design.

      Monday, 16-Aug-10 14:12:29 UTC

@bkuhn correct, PHP does not require Zend Framework or Zend's closed source modules/extensions.

@jwildeboer For modules it looks like it is part of core PHP (I think) http://www.zend.com/en/community/php

@jwildeboer You are right. I was confused between the Zend addons themselves and the engine. So what is the issue with it?

      @bkuhn check http://www.redhat.com/legal/patent_policy.html as well.

@osamak, I'm very familiar w/ that URL. I'm raising the issue that mere promises like that are not enough. #Red_Hat should issue a license.

      Monday, 16-Aug-10 14:44:19 UTC

@bkuhn Yes, true, but RedHat does take a position against #swpats, at least for now.

@osamak, #Microsoft took many positions against #swpats in the early 1990s. Every #swpats holder becomes a patent troll eventually.

@fontana, Yes, I mean "enforce #swpats". It's an expansive definition of "troll", I admit. Is there a formal definition of "patent troll"?

    • Bradley M. Kuhn Bradley M. Kuhn Richard Fontana

@fontana,I certainly like #estoppel, but are you saying that argument will work when #Red_Hat sells off its #swpats to aggressive enforcers?

    • Space Hobo Space Hobo

@bkuhn if the companies produce devices with those #swpats, then it may be problematic but I wouldn't consider them a "troll"

      Monday, 16-Aug-10 16:48:55 UTC
    • Bradley M. Kuhn Bradley M. Kuhn Space Hobo

@spacehobo, I dunno. It's surely troll-ish behavior (e.g., #swpats licensing revenue > product revenue, which probably happens w/ IBM often)

    • Space Hobo Space Hobo

@bkuhn there's a spectrum in #swpats from rent-seeking to monopoly-protection. I see trolls as the former, not the latter.
