@fontana, I agree #Red_Hat publication of #swpats promise set the bar too low, allowing #IBM & others to skirt issue. Fix it now, though!

So MSFT is cashing innovation tax (aka patent license money) for Android, now ORCL joins the scheme. And you still ask why #swpat are wrong?
-
@jwildeboer why make money from innovation when you can simply collect taxes from all the competition?
-
@jwildeboer, Does #Red_Hat believe #swpats are wrong, or is that just your personal opinion? Why won't Red Hat license its #swpats freely?

@bkuhn In #Patent_Absurdity, someone from #RedHat made statements against #swpats and said that it didn't advance innovation.
-
@bkuhn But sure, it is annoying that RedHat won't freely license its patents.
-
@bkuhn nice blog. One of the more level headed responces I've seen to OvG

@bkuhn It is first my personal belief (check my history, funny pics ;-) and Red Hat also opposing. But we have some defensive pat going on.
-
@bkuhn wrt freely licensing - that's for our legal experts. We have patent promise at least.
-
@bkuhn AFAIR we had our promise long before others did.
-
@bkuhn And as you can see at http://www.redhat.com/legal/patent_policy.html we DO include GPL v3.
-
@jwildeboer, promise is not a license; e.g. #Red_Hat reserves right to sell off patents to trolls. Why does RedHat insist on this power?
-
@bkuhn wrt to your blog entry - is PHP really safe? Isn't Zend a risk?
-
@jwildeboer, My understanding is that #Zend is not necessary to use #PHP. Am I mistaken? Also, AFAIK Zend post-dates PHP's design.
-
@bkuhn correct, PHP does not require Zend Framework or Zend's closed source modules/extensions.
-
@osamak huh?
-
@ashcrow but PHP does require the Zend enigine, innit?
-
@jwildeboer For modules it looks like it is part of core PHP (I think) http://www.zend.com/en/community/php
-
@ashcrow zend engine is still the core of PHP http://svn.php.net/viewvc/php/php-src/trunk/Zend/
-
@lxoliva it was a response to this http://identi.ca/notice/45714012
-
@jwildeboer You are right. I was confused between the Zend addons themselves and the engine. So what is the issue with it?
-
@bkuhn check http://www.redhat.com/legal/patent_policy.html as well.
-
@osamak, #Microsoft took many positions against #swpats in the early 1990s. Every #swpats holder becomes a patent troll eventually.

@jwildeboer, AFAIK #Zend Inc. didn't exist when #PHP was invented. ∴ company is unlikely to hold #swapts on original language implementation
-
@bkuhn nor do i really think zend is necessary to run php... it is core to 4 and 5, but perhaps i'm nai…
-
@jwildeboer ah, that is a good question. Given Oracle's latest move it would at least seem that PHP is safer--but I guess one never knows.
-
@mlinksva It's a class interest thing. If you're in the class of swpat holders, you act like an swpat holder... #misappliedmarxism
-
@bkuhn PHP4 and PHP5 are definitely not comparable to PHP3, so original language is fo no real use.
-
@jwildeboer, you've convinced me #swpats situation w/ #PHP deserves a second look. I updated the blog post to reflect this. (cc @ashcrow)
-
@bkuhn I was led to understand that "troll" is a non-producing patent enforcer.
-
@fontana i don't believe the mind gets corrupted by things like computer languages or porn, just press …
-
@bkuhn Yep. The traditional definition of a troll is one who cannot be sued back for patent violations
-
@bkuhn come on folks, stop playing. just grant a license to all your patents for all Free Software. Or at least all Copyleft Free Software.
-
@bkuhn not so sure about that if they put the right non-revocable (except for cause) license on them all for all Free Software.
-
@fontana please change that whole thing ASAP ;-) We can do better, I guess? ;-)
-
@bkuhn you're just one guy? I thought you were a borg collective of FreeSoftware hackers
-
@bkuhn I meant borg in that you seem to do the work of several, with a single focus. Not that your individuality was drained.
-
@fontana haha ... it's an amazing question. I guess it's time someone hired some college students and did a controlled study!
-
@fontana Made a comment on Rob's article http://bit.ly/atVDOo cuz of Gosling's reveal patents were intentional jokes. M&A is a real fear.
-
@rahulsundaram, Talking about public postings, particularly on that specific website. It's a very dangerous thing to speak your mind there.
-
@bkuhn Why so?
-
@bkuhn Red Hat runs #opensource.com as a community service & those are my legit community questions after reading Gosling's post. *shrug*
-
@bkuhn @rahulsundaram I don't think I dissented. I described the trap orgs like #Red_Hat are in. I'm not making it uglier by discussing it.
