Got details on #BlackDuck's indemnification plan: recently launched, let's company buy insurance against litigation after BlackDuck scan.

@ossguy, shrewd of #BlackDuck to sell insurance against litigation only, since most !GPL enforcement doesn't get so bad it needs litigation.

@ossguy, OTOH, if I were an #BlackDuck's actuary, I'd be appalled at how little a "#BlackDuck scan" correlates with !GPL compliance.

@bkuhn I may have mis-spoke. I assumed it was for litigation, but it might not be. I will try to clarify this with #BlackDuck.

@bkuhn I clarified with #BlackDuck that their indemnification is indeed just for litigation. It doesn't cover patent claims, etc. #LinuxCon

@ossguy, as I said, shrewd of them, given how infrequent litigation is for !GPL. My concern is: companies who buy it will *want* litigation!

@ossguy,I'm surprised #BlackDuck's actuaries didn't grok this:BlackDuck customers have incentive to ignore !GPL enforcement contact &be sued

@ossguy, is this information about #BlackDuck litigation indemnification written down anywhere? I'd like to write a blog post about it. !GPL

@bkuhn It is limited indemnification. You can buy coverage for a certain dollar value, but #BlackDuck won't cover beyond that.

@ossguy,my point stands:always cost effective to be sued (then settle) rather than answer initial contact if you bought #BlackDuck insurance

@ossguy,I now theorize #BlackDuck designed insurance program to force !Conservancy & !FSF to sue more on !GPL to feed their FUD. !disturbing

@bkuhn So you are saying that their insurance is worthless?

@satipera, not at all. It sounds like #BlackDuck insurance is designed to entice their customers to be sued to increase their FUD machine.

@bkuhn I don't know. The #BlackDuck guy I talked with said he'd email me more information about their indemnification plan.
