The law could take a middle ground: only allow the use of such "orphan" works in copyleft works.

right but, with bad intentions, I could just offer license for two pennies and give you one. I need to be able to be bound somehow.

could you instead give a guarantee to bring a suit should the licensee fund it? problems?

shouldn't really be. We can have a photo of a sculpture, a sketch of the same, and a copy in the same or another substance, etc.

so, if you and I co-write a a song say, can we each issue licenses to others without the permission or approval of the other?

you destroy the actual work that is even though you may make a new work in its place. Well with enough mods at least.

So, when I make a one off sculpture and license it #copyleft-next ? Is it its own source? If you make modifications to it, you destroy it.

could you assign everyone a co-ownership while somehow restricting them for issuing *other* licenses without your approval?

I think that assumes that everyone is not a co-owner of the copyrights.

could we just speel out that source is not required for non-code or at least non-digital?

@fontana - could there be some way to give licensees of #copyleft-next the standing they would need to get source on their own initiative?
