CVS Telemarketing Opt-out

David Chung at

In case anyone needs to, the procedure is as follows:

- Call +18007467287

- Navigate the phone-tree: 8 (more options) -> 4 (automated call preferences) -> 4 (other options)

- You'll be connected with a human where you will need to verify your name, DOB, and phone number to opt-out

So I've been receiving automated telemarketing calls from CVS despite their consent language failing to indicate that the number supplied will be used for that purpose. During the COVID-19 lockdown, their consent disclaimer did include marketing communication, which was why I refused to setup an appointment with them. However, they recently changed that language to indicate that the number supplied for setting up an appointment is for that purpose only.

I'm on the do-not-call registry and am very careful on what I'm consenting to. I'm apparently one of the few who actually reads the TOS and privacy policies.

Thanks to CVS, I've been reading the regulations about this: https://www.ftc.gov/business-guidance/resources/complying-telemarketing-sales-rule

It turns out there is an establish business exemption where no consent is required: https://www.ftc.gov/business-guidance/resources/complying-telemarketing-sales-rule#businessrelationship

That section does indicate "but not automated calls or robocalls" so perhaps I should be reporting the violation to the FTC!

Upon further research, it turns out the caller is a scammer and have been spoofing CVS.

Well, it's good to get on CVS' do-not-call list anyway but now I can proceed with the FTC report for a different reason.
