Yeah, you're at the point Matthew is complaining about; the policy is deliberately unclear about what it means.
If you take the policy literally, Trisquel would have to recompile everything to remove "Ubuntu", including from the package names.
I don't doubt that Canonical would lose if they took someone to court over it, but talking to Canonical is cheaper than going to court.
